2. Definitions

 

This Privacy Policy uses terms defined in the FADP and GDPR. In particular, "personal data" means any information relating to an identified or identifiable natural person. "Data subject" is the person whose data is processed. "Processing" includes any handling of personal data, regardless of the means and procedures applied, in particular the collection, storage, retention, use, modification, disclosure, archiving, deletion, or destruction of data.

 

3. General Data Processing

 

We primarily process personal data to provide, operate, secure, and improve our Website, to respond to inquiries (especially via contact forms and for quote requests), to initiate potential business relationships, and to comply with our legal obligations in Switzerland and, where applicable, abroad.

 

4. Processing of Personal Data When Visiting Our Website

Each time you access our Website, our hosting provider (Wix.com Ltd., hereinafter "Wix") automatically collects information of a general nature. This data is processed for the following purposes:

 

  • Ensuring a smooth connection setup of the Website,

  • Ensuring smooth use of our Website,

  • Evaluating system security and stability, and

  • For other administrative purposes. The legal basis for this data processing is our legitimate interest (Art. 31(1) FADP / Art. 6(1)(f) GDPR) in the technical provision, security, and optimization of our Website. This data is not used to draw conclusions about your person, unless necessary for investigating cases of misuse or for legal prosecution. The data is deleted as soon as it is no longer required for the purpose of its collection, at the latest according to the deadlines set by Wix.

 

b) Contact Form and Quote Request

If you send us inquiries via the contact form (provided by Wix Forms) or using the quote request function, your details from the inquiry form, including the contact data you provide there (e.g., name, company, email address, phone number, details of the inquiry), will be stored and processed by us for the purpose of handling the request and in case of follow-up questions. We do not share this data without your consent, unless it is necessary to process your request (e.g., internal forwarding to the responsible employee). The processing of this data is carried out for the implementation of pre-contractual measures or to respond to your inquiry (Art. 31(2)(a) FADP / Art. 6(1)(b) GDPR) and based on our legitimate interest in efficiently processing the inquiries addressed to us (Art. 31(1) FADP / Art. 6(1)(f) GDPR). The data you enter remains with us until you request its deletion, revoke your consent to storage (if processing was based on consent), or the purpose for data storage no longer applies (e.g., after your request has been fully processed), provided that no statutory retention obligations conflict with this.

Wix also collects data as part of providing the Website and through integrated tools. Wix acts partly as our processor (when processing data on our behalf, e.g., form data) and partly as its own controller (e.g., for analyzing the use of the Wix platform itself). Wix may use cookies and collect data about your use of our Website (e.g., IP address, pages visited, device data, interactions). This data may also be stored and processed on Wix servers in various countries, including Israel and the USA. Data processing by Wix is based on our legitimate interest (Art. 31(1) FADP / Art. 6(1)(f) GDPR) in a professional, secure, and functional website presence, as well as for the analysis and optimization of our Website. Where Wix processes data on our behalf, we have concluded a Data Processing Agreement (DPA) with Wix. For data transfers to Israel, an adequacy decision exists from both Switzerland and the EU. For data transfers to the USA, Wix relies on appropriate safeguards such as the EU Commission's Standard Contractual Clauses (SCCs) and assesses additional protective measures. b) Google Analytics

Subject to your consent via the cookie banner, this Website uses Google Analytics, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). Google Analytics uses cookies (see Section 5) that enable an analysis of your use of the Website. The information generated by the cookie about your use of this Website is usually transmitted to a Google server in the USA and stored there. We have activated IP anonymization on this Website. This means that your IP address will be truncated by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. On behalf of Tech Connect, Google will use this information to evaluate your use of the Website, compile reports on website activity, and provide other services related to website activity and internet usage to us. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. c) Google Fonts

We use Google Fonts, provided by Google, on our Website for the uniform display of fonts. When you call up a page, your browser loads the required web fonts directly from Google's servers into your browser cache to display texts and fonts correctly. For this purpose, the browser you use must connect to Google's servers (usually in the USA). This informs Google that our Website was accessed via your IP address. Other data such as browser type and version may also be transmitted to Google. The use of Google Fonts is in the interest of a uniform, appealing, and efficient presentation of our online offers. This constitutes a legitimate interest within the meaning of Art. 31(1) FADP / Art. 6(1)(f) GDPR. Data transfer to the USA is based on the EU Commission's Standard Contractual Clauses and potentially the certification under the EU-U.S. Data Privacy Framework. d) Google Maps

This Website uses the map service Google Maps via an API, offered by Google Ireland Limited. To use the functions of Google Maps (e.g., displaying an interactive map of our location), it is necessary to store your IP address. This information is usually transmitted to a Google server in the USA and stored there. We have limited influence on the data transmission and further processing by Google. The use of Google Maps is in the interest of an appealing presentation of our online offers and to make it easy to find the locations indicated by us on the Website. If we request consent for its use (e.g., via the cookie banner, as cookies may be set), the legal basis is your consent (Art. 6(6) FADP / Art. 6(1)(a) GDPR). Otherwise, the use may be based on our legitimate interest (Art. 31(1) FADP / Art. 6(1)(f) GDPR) in providing this service. e) Google reCAPTCHA

To protect our contact forms from misuse by automated bots, we use the reCAPTCHA service from Google Ireland Limited. reCAPTCHA checks whether the data input on our Website (e.g., in the contact form) is made by a human or by an automated program. For this purpose, reCAPTCHA analyzes the behavior of the website visitor based on various characteristics. This analysis begins automatically as soon as the website visitor enters the website or uses the form. For the analysis, reCAPTCHA evaluates various information (e.g., IP address, duration of the visitor's stay on the website, mouse movements made, browser and device data). The data collected during the analysis is forwarded to Google and may be processed in the USA. The data processing is based on our legitimate interest (Art. 31(1) FADP / Art. 6(1)(f) GDPR) in protecting our web offers from abusive automated spying and SPAM. Data transfer to the USA is based on the EU Commission's Standard Contractual Clauses and potentially the certification under the EU-U.S. Data Privacy Framework. f) Google Tag Manager

We use Google Tag Manager on our Website, provided by Google Ireland Limited. Google Tag Manager is a solution that allows us to manage website tags via an interface (e.g., integrate Google Analytics or other marketing services into our website). The Tag Manager itself (which implements the tool) is a cookie-less domain and generally does not collect personal data. However, the tool triggers other tags, which in turn may collect data. Google Tag Manager does not access this data. If a deactivation has been made at the domain or cookie level (e.g., rejection of analysis cookies in the cookie banner), this also applies to all tracking tags implemented with Google Tag Manager. The use of Google Tag Manager serves the simplified and efficient management of our website tags and is based on our legitimate interest (Art. 31(1) FADP / Art. 6(1)(f) GDPR) or on the consent you have given for the services integrated via the Tag Manager (such as Google Analytics). System-related data may also be transmitted to Google servers, potentially in the USA, when using the Tag Manager. 7. No Disclosure of Data to Third Parties (Other Than Those Mentioned)

 

Your personal data will generally not be transferred to third parties for purposes other than those listed in this Privacy Policy. We only share your personal data with third parties if:

 

  • You have given your express consent to do so,

  • The disclosure is necessary for the processing of inquiries or the fulfillment of (pre-)contractual measures with you,

  • There is a legal obligation to disclose (e.g., to authorities),

  • The disclosure is necessary to protect our legitimate interests (e.g., for legal defense) and there is no reason to assume that you have an overriding legitimate interest in not disclosing your data.

 

Our service providers (such as Wix and Google) who process data on our behalf (processors) are carefully selected, contractually obliged to comply with data protection regulations, bound by our instructions, and regularly monitored.

 

8. International Data Transfers

 

As described in Section 6, your data may also be transferred to countries outside Switzerland and the European Economic Area (EEA), in particular to Israel and the USA, when using services such as Wix and Google. For Israel, there is an adequacy decision from both Switzerland and the EU, confirming an adequate level of data protection. For the USA and other countries without an adequacy decision, we ensure that an adequate level of data protection is guaranteed or an exception applies. This is primarily done by concluding Standard Contractual Clauses (SCCs) approved by the Swiss Federal Data Protection and Information Commissioner (FDPIC) or the EU Commission, supplemented by an assessment of additional protective measures within the framework of a Transfer Impact Assessment (TIA) where necessary. Furthermore, the certification of US companies under the EU-U.S. Data Privacy Framework (and its recognition by Switzerland) can serve as a basis. In certain cases, a transfer may also be based on your explicit consent.

 

9. Data Security

 

We take appropriate technical and organizational security measures (TOMs) to protect your data against accidental or intentional manipulation, partial or complete loss, destruction, or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments. Communication via our Website uses SSL/TLS encryption (recognizable by "https://" in the address bar).

 

10. Storage Duration

 

We store your personal data only for as long as necessary to achieve the respective purposes (e.g., processing your request, duration of the business relationship) or as required by statutory retention periods (e.g., under commercial or tax law, usually 10 years). Once the processing purpose ceases to apply or the statutory retention periods expire, the data is routinely blocked or deleted in accordance with legal requirements.

 

11. Your Rights as a Data Subject

  • Right to Erasure ("Right to be Forgotten"): You can request the deletion of your personal data stored by us, provided that no statutory retention obligations or other justifications (e.g., for asserting legal claims) conflict with this (Art. 32(2)(c) FADP / Art. 17 GDPR).

  • Right to Restriction of Processing: Under certain conditions, you can request the restriction of the processing of your data (Art. 32(2)(a), (b) FADP / Art. 18 GDPR).

  • Right to Object: You have the right to object, on grounds relating to your particular situation, at any time to the processing of your personal data based on legitimate interests (Art. 30(2)(b) FADP / Art. 21 GDPR).

  • Right to Withdraw Consent: If processing is based on your consent, you can withdraw this consent at any time with effect for the future (Art. 6(7) FADP / Art. 7(3) GDPR). The lawfulness of the processing carried out until the withdrawal remains unaffected.

  • Right to Data Portability: You have the right to receive data that we process automatically based on your consent or in fulfillment of a contract, in a structured, commonly used, and machine-readable format, or to request its transmission to another controller, where technically feasible (Art. 28 FADP / Art. 20 GDPR).

  • Right to Lodge a Complaint: You have the right to lodge a complaint with a competent data protection supervisory authority if you believe that the processing of your personal data violates data protection law (Art. 49 FADP / Art. 77 GDPR). The competent supervisory authority in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, CH-3003 Bern (https://www.edoeb.admin.ch/edoeb/en/home.html).

12. Obligation to Provide Data

 

Within the scope of our business relationship (especially for quote requests and contract conclusions), you must provide the personal data that is objectively necessary for establishing, conducting, and terminating a business relationship and fulfilling the associated (pre-)contractual obligations. Without this data, we will generally not be able to process your request, prepare an offer, or conclude or execute a contract with you. The use of the Website also requires the processing of certain data (e.g., IP address) to enable connection and display.

 

13. No Profiling / No Automated Decision-Making

 

We do not use your personal data for profiling within the meaning of the FADP or for purely automated decision-making within the meaning of Art. 22 GDPR that produces legal effects concerning you or similarly significantly affects you.

 

14. Changes to this Privacy Policy

 

We reserve the right to adapt this Privacy Policy occasionally so that it always complies with current legal requirements or to implement changes to our services or data processing in the Privacy Policy. Your subsequent visit will then be subject to the new Privacy Policy. We recommend that you review the Privacy Policy regularly.
